The Arbitration Court of Chelyabinsk region has decided to recover the benefit of "MRSC of Urals" 329 million rubles from "Magnitogorsk retailing company. It is the supplier of electricity to pay for power grid company for the first half of 2009. The disputed situation arose after the "IEC", as some other marketing companies, refused to pay for delivered electricity to the installed capacity, noted in the IDC report.

When a contract for services on the transfer of electricity to the IEC in 2009 and "MRSC of Urals" was no agreement, and therefore, the IEC has asked the court for the settlement of disputes under the contract. In December 2009, the eighteenth Arbitration Appeal Court accepted the terms of the contract services in the editorial "MRSC of Urals".

The Court ruled that in accordance with applicable law payment for the services of the company network through a two part tariff should be based on a planned quantity of power, declared by the customer for a year, and approved in the tariff. Now the decision of the Arbitration Court of Chelyabinsk region with JSC "IEC" in favor of JSC "MRSC" to collect a debt for services rendered during the first half of 2009 amounting to 329 million rubles. In accordance with the decision of the court IEC must pay for services based on the size of the installed capacity.

"This jurisprudence stabilizes the contractual relationship network of the company and the consumer and provides vypolnyaemost tariff-making, bbcfecause it allows the consumer to renounce unilaterally declared by them in the tariff control period prior to the scheduled values of power in case of change of the situation in the electricity market", - commented on the head of the Legal Department "MRSC of Urals" Aleksey Sanin.
